Terms and Conditions of Credit

1. The Customer agrees to inform the Carrier promptly in writing of any changes to the details provided in their credit application.

 

2. The Carrier will invoice the Customer weekly but reserves the right to, from time to time, change the billing frequency without giving notice to the Customer.

 

3. The invoice shall be deemed to have been received by the Customer 48 hours after issuing, regardless of the delivery method.

 

4. The Customer shall at all times indemnify the Carrier from any loss or damage, and/or expense sustained or incurred by it as a direct or indirect consequence of granting the Customer a credit account.

 

5. The Carrier may, for any breach of the Terms and Conditions of Credit and/or the Terms and Conditions of Carriage commence legal action against the Customer, and the Customer shall be liable for any charges and fees related to such legal actions, including legal costs on a full indemnity basis.

 

6. The Carrier may terminate the credit account at any time without giving notice of termination to the Customer.

 

7. The Customer shall, upon termination of the credit account, pay the Carrier all outstanding amounts within 30 days.

 

8. The Customer agrees that if it is late or defaults in any payment under the Carrier’s payment terms, then the full amount becomes immediately due and payable, and credit facilities may be withdrawn at any time.

 

9. The Customer agrees that the Carrier might give to and seek from any credit reporting agency or other credit providers personal and/or commercial credit information about the Customer, including information about credit worthiness, credit standing, credit history or credit capacity that credit providers are allowed to give or obtain under the Privacy Act, and use this information to assess this application, notify other credit providers of a default by the Customer, or collect overdue payments.

 

10. The Customer agrees that these Terms and Conditions of Credit incorporate fully the Carrier’s Terms and Conditions of Carriage, and that in the event of any contradictory term or condition in these Terms and Conditions of Credit, the Terms and Conditions of Carriage will prevail.
